1. Agreement to Terms

By accessing or using FixDoc ("the Service"), provided by ByteUp LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

FixDoc is a software-as-a-service (SaaS) platform that provides AI-powered document verification and fraud detection tools for mortgage professionals. FixDoc is a technology service provider and is not a mortgage lender, broker, or financial advisor. The Service is intended to assist NMLS-registered professionals in their independent document verification process.

3. User Accounts

• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• One person or entity may not maintain more than one account per organization.

4. Acceptable Use

You agree not to:

• Upload documents that you do not have authorization to process.
• Use the Service for any illegal purpose or to facilitate fraud.
• Attempt to bypass plan limits, rate limiting, or access controls.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Share your account credentials with unauthorized parties.

5. Subscription and Billing

• Paid plans are billed monthly or annually as selected at signup.
• All plans include a 14-day free trial. No credit card is required to start a trial.
• You may cancel your subscription at any time. Access continues until the end of the current billing period.
• We reserve the right to change pricing with 30 days notice to existing subscribers.
• Annual plans include a 30-day money-back guarantee.

6. AI-Powered Features

The Service uses artificial intelligence to parse documents, detect potential fraud, and provide conversational answers about project data. AI outputs are provided as decision-support tools and should not be treated as definitive conclusions. You are responsible for independently verifying all AI-generated results before making lending or compliance decisions. Confidence scores indicate the level of supporting evidence available, not a guarantee of accuracy.

7. Data Ownership

You retain full ownership of all documents and data you upload to the Service. We do not claim any intellectual property rights over your content. We process your data solely to provide the Service as described. See our Privacy Policy for details on how we handle your data.

8. Limitation of Liability

To the maximum extent permitted by law, ByteUp LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated results will be accurate or complete. The Service is a technology tool, not a substitute for professional judgment in lending decisions.

10. Termination

We may suspend or terminate your access to the Service if you violate these Terms. Upon termination, you may export your data within 30 days. After 30 days, data is eligible for permanent deletion in accordance with our retention policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law provisions.
